THE HON’BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON’BLE SRI JUSTICE SANJAY KUMAR WRIT APPEAL No.1670 of 2014 Judgment: (per Sri Sanjay Kumar,J) The petitioner in W.P.No.15315 of 2014 is in appeal against the order dated 24.11.2014 passed therein dismissing the case. We however find no grounds to interfere with the order passed by the learned Single Judge for the reasons stated hereunder.
Admittedly, the writ petitioner did not claim any interest in the Government land situated in Survey No.910/2 of Malkajgiri Village. He lays claim only to the land in Survey No.910/1 of the said village, which is admitted by the State functionaries to be patta land.
Sri A. Ravinder Reddy, learned counsel for the appellant-writ petitioner, however stated that as the writ petition was dismissed, the respondents may take steps to dispossess the appellant even before any delineation is carried out in terms of the order under appeal.
The learned Government Pleader for Revenue, however, submits that no steps would be taken for removal of encroachments in the Government land until the survey is completed.
In the light of this statement, the apprehension of the appellant- writ petitioner stands redressed.
The Writ Appeal is accordingly closed.
Pending miscellaneous applications, if any, shall also stand closed. No order as to costs.
