When the matter is called today, none appeared for the petitioner. Learned standing counsel for the respondent is present. He states that a tender notification was issued on 15.07.2009 for leasehold rights for collection of market fee (selling and purchasing of goats and sheeps) in the area of Mancherial Municipality market for the period from August 2009 to March 2011 and in the said auction, the petitioner became highest bidder. The relief sought in the writ petition was challenging the action of the respondent in preventing the petitioner from collecting live stock market fee (mekala mandi) situated in Sy.No.262, admeasuring Ac.0.12-1/2 guntas at Rallapet, Mancherial Mandal, Adilabad district and consequently directing the respondents not to interfere from collection of livestock market fee till March 2011.
2. There is no interim order in the writ petition till today. In that view of the matter, learned standing counsel states that the writ petition has become infructuous.
3. Recording the statement of the learned standing counsel for the respondent, the writ petition is dismissed as infructuous. Pending miscellaneous petitions in this writ petition, if any, shall stand dismissed in consequence. No order as to costs.
