Heard learned counsel for the petitioner; Sri Devendra Kumar for the respondent no.1; the learned Standing Counsel for the respondents 2 to 4; and perused the record.
The present petition has been filed for a direction upon the respondents to decide the representation of the petitioner in respect of payment of compensation for the land allegedly acquired by the National Highway Authority of India for road widening.
In the writ petition it is not disclosed that any award has yet been passed although Sri Devendra Kumar, learned counsel for the respondent no.1, has stated that an award has been passed on 20.05.2016.
In case, an award has been passed and the petitioner is not satisfied with the award, then the remedy for the petitioner lies under Section 3 G (5) of the National Highways Act, 1956. However, if the petitioner is satisfied with the award she may seek for enforcement of the award before appropriate forum.
