None appears to press the writ petition on behalf of the petitioner. However, learned Standing Counsel for the respondent-State is present.
The petitioner has assailed the order dated 4.8.2008 in the writ petition. The petitioner was directed to handover the charge of officiating principal to the respondent No.4. It is settled law that the senior most teacher is required to hold the charge of officiating principal. In the counter affidavit, it is asserted that the petitioner is not the senior most teacher and her name stands at serial no.4 of the seniority list. It is also asserted in the counter affidavit that the respondent no.4 was appointed on the post of lecturer by the Uttar Pradesh Public Service Commission. Hence, the challenge of the petitioner that the respondent No.4 is not qualified to hold the charge of officiating principal does not hold good. Moreover, 10 years have elapsed. No subsequent developments have been brought in the record by the petitioner.
The writ petition lacks merit and is dismissed. Interim order, if any, stands discharged.
