Heard Sri R.K. Shukla, learned counsel for the petitioner, Sri G.P. Singh, learned A.G.A. for the State and perused the impugned F.I.R. as well as material brought on record.
This petition has been filed with the prayer to quash the F.I.R. dated 11.4.2019, registered as Case Crime No.224 of 2019, u/s 419, 420 IPC, P.S. Rohaniya, district Varanasi.
Learned counsel for the petitioners submits that some of the FIR's have been registered against the petitioner and in one of the FIR which was challenged by him in Criminal Misc. Writ Petition No.25195 of 2018, interim protection has been granted in his favour by this Court on 11.9.2018 copy of the same is annexed on page 34 of the present petition. He further submits that today also in Criminal Misc. Writ Petition No.16133 of 2019 and 16136 of 2019, which are listed at serial no.78 and 81, interim protection has been granted in his favour by this Court. The allegations levelled against the petitioner is false, frivolous and baseless.
Learned A.G.A. opposed the prayer for quashing but could not dispute the aforesaid fact as argued by learned counsel for the petitioner.
Considering the submissions advanced by learned counsel for the parties and nature of the allegations, it is directed that the petitioner shall not be arrested in above mentioned case, till the submission of the police report under section 173(2) Cr.P.C. but shall co-operate with the investigation of the case.
With the above direction this petition is finally disposed of.
