For Petitioner : Mr.K.Balaji For R1 : Mr.C.Emalias, APP ORDER This Criminal Original Petition has been filed seeking a direction to the first respondent police to complete the investigation in Crime No.1022 of 2014 pending on his file and file the final report before the appropriate court.
2. The case of the petitioner is that as against the respondents 2 and 3 herein, he has lodged a complaint and the same was registered as FIR in Crime No.1022 of 2014 on the file of the first respondent police for the offences punishable under Sections 465, 466, 468, 471, 420 r/w Section 120(b) IPC. Apprehending arrest, the respondents 2 and 3 approached this Court by filing Crl.O.P.No.33236/2014 seeking anticipatory bail, in which, the petitioner has intervened the matter. After hearing both sides, this Court has referred the matter for mediation, wherein, a Memorandum of Understanding (MOU) dated 30.04.2015 came to be executed by both parties. Based on the said MOU, this Court by order dated 11.06.2015, disposed of the said petition. In view of the same, the respondents 2 and 3 were initially co-operating with the petitioner. Thereafter, they did not respond properly, which compelled the petitioner to request the first respondent to take action in Crime No.1022 of 2014. Finding no response, he has come up with the present petition for the above stated relief.
3. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor, who took notice for the first respondent.
4. Considering the facts and circumstances of the case, this Court directs the first respondent police to investigate the case in Crime No.1022 of 2014 pending on his file and file a final report, if not filed earlier, as expeditiously as possible, preferably, within a period of six weeks from the date of receipt of a copy of this order.
5. Accordingly, the Criminal Original Petition is ordered.
