Heard learned counsel for the parties.
The present petition has been filed alleging that petitioner is running a retail outlet in terms of agreement with Indian Oil Corporation Limited. The petitioner is required to establish new equipments to apply with the automation process as been decided by Indian Oil Corporation, however, respondent no. 5, with whom, a litigation is going on in the Civil Court, is not allowing him to do so. The petitioner has requested that he may be permitted to approach the District Magistrate, Jalaun highlighting this problem.
Considering the said submission made by learned counsel for the petitioner, we permit the petitioner to make an application before the District Magistrate, Jalaun, respondent no. 2, within a period of three weeks, from today and, in the event, the said representation is filed along with certified copy of this order, the District Magistrate shall pass a reasoned order within a period of two months, from the date of production of a certified copy of this order.
We have not gone into the merits of the allegations made in the writ petition and the respondent no. 2 shall not be guided by any observations made in this order while deciding the application filed by the petitioner.
The writ petition is disposed off in terms of the said order.
