JUDGMENT / ORDER

ORDER:
This Writ Petition is filed for the following substantive relief:
“ to issue an appropriate writ or order or direction more particularly one in the nature of Writ of Mandamus declaring the mala fide act on the part of respondent No.3, in not releasing the stock of essential commodities to the petitioner’s fair price shop for the purpose of distribution of the same to the card holders for the month of November 2014 onwards in respect of FP Shop No.28, Allikesam, Renigunta Mandal, Chittoor District without any cogent reason, though the petitioner paid the requisite amount by way of DD dated 18.10.2014, as wholly arbitrary, illegal and without jurisdiction and consequently, to direct respondent No.3 to release the essential commodities to Petitioner's fair price Shop No.28, Allikesam, Renigunta Mandal, Chittoor District every month.”
In view of the serious allegations made in the affidavit against respondent No.3, his personal appearance was directed by order, dated 18.11.2014.
At the hearing, respondent No.3 is personally present and he has submitted that as he has not received Demand draft from the petitioner for the month of November, 2014, he has not issued the release order and that for the month of December, 2014, the petitioner has submitted the Demand Draft and a release order has been issued. He has further stated that he will discharge his functions properly without being influenced by extraneous reasons in future.
In view of the corrective steps taken by respondent No.3 by issuing the release order for the month of December, 2014 and the assurance given by him, the Writ Petition is disposed of as infructuous.
As a sequel, WPMP.No.43644 of 2014 is disposed of as infructuous.
