The present Criminal Original Petition has been filed seeking a direction to the respondent not to harass the petitioner by insisting him to give up the demand for loan amount advanced to the defacto complainant and the interest amount accrued thereon.

It is the case of the petitioner that he has lodged a complaint on 10.01.2017 to the Sub Inspector of Police, Namagiripet Police Station, against one Balasubramani for causing bleeding injury, when he asked for return of loan amount. In order to harass the petitioner, the said Balasubramani has lodged a counter complaint against him for the alleged offence punishable under Section 3(1)(x) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 and Section 506(1) IPC on 11.01.2017. Pursuant to the same, the respondent police is pressurising the petitioner not to demand the loan amount advanced to the defacto complainant and the interest accrued thereon, failing which, the counter complaint will be registered and he will be detained for the same. Hence, this petition.
3. Learned Additional Public Prosecutor submitted that there is no harassment caused by the respondent police as alleged by the petitioner. However, learned Additional Public Prosecutor submitted that the petitioner is required for enquiry.

Considering the facts and circumstances of the case and also taking note of the submission made by the learned Additional Public Prosecutor, this Court directs the petitioner to appear before the respondent police on 27.02.2017, on which date, the enquiry, if any, shall be completed by the respondent police. It is made clear that there shall be no harassment on the petitioner in respect of the civil dispute.
5. Accordingly, this Criminal Original Petition is disposed of.
