The claim of the petitioner is to accord benefit of 7th Pay Commission as admissible to him pursuant to the Government Order dated 16.12.2016 readwith the Government Order dated 23.12.2016, which was modified vide Government Order dated 15.2.2017.
The submission of learned counsel for the petitioner is that the petitioner has represented to respondent no. 4 namely the Finance and Accounts Officer, Basic Education, Azamgarh on 15.4.2019 and 26.4.2019, but no decision has yet been taken.
Only prayer in the present writ petition is to issue a direction to the respondent no. 4 to take a decision in accordance with law within stipulated period.
This submission of learned counsel for the petitioner is not disputed by the counsel for the respondents.
In view of the aforesaid prayer, without expressing any opinion as to the merits of claim of the petitioner, the present writ petition is being disposed of with the direction to respondent no. 4 namely the Finance and Accounts Officer, Basic Education, Azamgarh to consider the claim of the petitioner in accordance with the relevant Government Orders issued from time to time.
A reasoned and speaking order in accordance with law shall be passed, preferably, within a period of two months from the date of submission of certified copy of this order.
