Heard learned counsel for the petitioner, learned Standing Counsel for the Respondent Nos. 1 and 2 and Sri Vipul Kumar for the insurance company.
The claim of the petitioner under the Mukhya Mantri Kisan Evam Sarvhit Bima Yojana is allegedly kept pending because the viscera report is awaited inasmuch as from the postmortem report the cause of death could not be ascertained though it has been claimed by the petitioner that the deceased died of snake bite.
Under the circumstances, without expressing any opinion whether a case of snake bite could be ascertained on the basis of viscera report, we deem it appropriate to dispose of this petition by giving liberty to the petitioner to file a fresh petition after receipt of the viscera report. Liberty is also given to the petitioner to represent to the second respondent, where the claim is pending, to call for the viscera report from the concerned department.
