Heard learned counsel for the petitioner, Sri Mrigraj Singh, learned counsel representing the Basic Education Officer and the learned Standing Counsel for the State-respondents.
The claim of the petitioner is for payment of salary for the period 24 February 1996 to 5 November 1997. This claim itself rests on the decision rendered by a learned Judge on Rajeev Ratanam Tiwari and 35 Others Vs. State of U.P. And 4 Others [Writ -A No. 5030of 1998, decided on 19 April 2000].
In view of the aforesaid, Sri Singh, learned counsel representing the Basic Education Officer states that subject to verification of all facts and contentions on merits being left open, the claim as addressed on this petition, shall be duly evaluated and a final decision communicated with expedition and preferably within a period of four months from the date of presentation of a duly authenticated copy of this order along with a copy of the writ petition and its enclosures.
Accordingly and without going into the merits or otherwise of the claim of the petitioner, this petition shall stand disposed of in light of the statement, which is noted and recorded above.
