This writ petition has been filed by the petitioner, interalia, for the following relief:
"A. Issue a writ, order or direction in the nature of Mandamus directing the respondent's authority to consider the accidental claim of the petitioner regarding death of family which is pending before them within stipulated period."
Heard learned counsel for the parties and perused the record.
Learned counsel for the petitioner submitted that the husband of the petitioner namely Phoolchand son of late Bhaganwan Deen, an agricultural labour died on 12.10.2018 in a road accident. The family of the petitioner is living under below poverty line. He further submitted that petitioner had already filed a claim under "Chief Minister Kisan Avam Sarvhit Yojna" and the same is pending before the Respondent No. 2/appropriate authority since 1.12.2018 but the claim of the petitioner has been processed till date.
Considering the facts and circumstances of the case, Respondent No. 2/concerned authority is directed to decide the claim of the petitioner within a period of 15 days from the date of receipt of a certified copy of this order.
We make it clear that we have not entered into the merits of the claim made by the petitioner and the same shall be decided by the authority concerned on its own merits.
With the above observation, this writ petition is finally disposed of.
