ORDER:
This writ petition is filed for the following substantive relief: “…to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus, declaring the action of the respondent authorities in not permitting the petitioners to pursue their IV year, I semester of B.E. –2014-15 course even after they attained eligibility by attending their respective course classes as being illegal, arbitrary and to grant such other relief or reliefs as this Hon’ble Court deems fit and proper in the circumstances of the case.”
At the hearing, learned counsel for the petitioners has not disputed that as per the Regulations of respondent No.1 University, if a student has more than 12 backlogs, he/she is not entitled to promotion to the next year. It is also not disputed by the learned counsel that his clients have more than 12 backlogs in the 3rd year B.E. course.
In the face of these admitted facts, the detention of the petitioners in 3rd year B.E. course, which is in conformity with the University Regulations, cannot be termed as illegal or arbitrary. This Court cannot entertain any writ petition and grant relief, which runs contrary to the University Regulations.
Therefore, I do not find any merit in this writ petition and the same is accordingly dismissed.
As a sequel to the dismissal of the writ petition, W.P.M.P.No.47497 of 2014 shall stand disposed of as infructuous.
