JUDGMENT / ORDER

IN THE HIGH COURT OF JUDICATURE AT HYDERABAD FOR THE STATE OF TELANGANA & THE STATE OF ANDHRA PRADESH (Special Original Jurisdiction) WEDNESDAY, THE TWENTY FOURTH DAY OF SEPTEMBER TWO THOUSAND AND FOURTEEN PRESENT THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.28822 of 2014 BETWEEN A.B. Sivarami Reddy.
AND ... PETITIONER The Government of Andhra Pradesh, Rep. by its Principal Secretary, Revenue Department, Secretariat, Hyderabad and others.
...RESPONDENTS Counsel for the Petitioner: MR. P. RAMBHOOPAL REDDY Counsel for the Respondents: GP FOR REVENUE (AP) The Court made the following:
ORDER:
Petitioner was given a notice dated 21.12.2013 under Section 7 of the Madras Act 3 of 1905 by the fourth respondent and the petitioner, admittedly, submitted a detailed explanation on 30.12.2013.
2. Learned counsel for the petitioner submits that no further orders are passed so far and the matter is pending before the fourth respondent. The present writ petition, however, is filed on the ground that without passing any order, there is threat of dispossession of the petitioner.
3. I do not see any reason for the petitioner to entertain such an apprehension inasmuch as if really the fourth respondent was to dispossess the petitioner, he would not have given him notice under Section 7 of the aforesaid Act.
The writ petition is disposed of with a direction to the fourth respondent to consider the explanation of the petitioner and pass appropriate orders and till passing of such orders, not to interfere with the possession of the petitioner. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
