1. In course of the hearing of the matter, it was jointly submitted by learned advocates for the parties that before the Mediation center of this Court in the presence of learned Mediator, the parties have settled their disputes and as agreed by the parties, learned Mediator has recorded the consent terms dated 21.09.2012. Under the said settlement, it is agreed that the husband-Mr Atulkumar Pravinchandra Vala shall pay total amount of Rs. 7,50,000/- by way of full and final settlement towards permanent alimony to the wife-the applicant herein. It was stated before this Court that out of the said total amount, amount of four lakhs have already been paid by the respondent.
2. Today a demand draft No. 021562 dated 3.12.2012 of HDFC Bank for Rupees 2 lakhs is handed over to the applicant in the Court. The remaining amount of Rs. 1,50,000/- shall be paid on or before 9th January, 2013, as stated on instruction by learned advocate for the respondent. Both the learned counsels requested to court is requested to the Court to keep this matter on 9th January, 2013. It is submitted that during the interregnum period, both the parties will withdraw all the proceedings filed between them before the Family Court and shall jointly carry out the necessary formalities for taking mutual divorce before the family court.
3. Considering the aforesaid aspects, s.o to 09.01.2013.
