JUDGMENT / ORDER

This Criminal Original Petition has been filed to modify the condition imposed in Crl.M.P.No.2972 of 2016 dated 08.11.2016 on the file of the Special Court under the TNPID Act Cases, Coimbatore.
2. Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl. Side) appearing for the respondent.
3. The order passed in Crl.M.P.No.2972 of 2016 reads as follows:-
"In the result, the Bail Application of the 2nd petitioner / A-3 namely Annathurai is allowed and the 2nd petitioner / A-3 Annathurai is enlarged on Bail with the following conditions:-
(i) The 2nd Petitioner/A-3 Annathurai has to deposit an amount of Rs.10 Lakhs into the Court (ii) He also has to execute a Bond for Rs.10 Lakhs with two sureties for a likesum, who must be close relatives of the 2nd Petitioner / A-3 Annathurai and (iii) The sureties shall deposit original Title Deed for the worth of Rs.10 Lakhs as a security (iv) Further, the 2nd Petitioner / A-3 namely Annathurai has to report before the EOW-II Police, Coimbatore daily twice at morning 10.00 A.M. and evening 5.00 P.M. and (v) Further, he shall report before the Court on the 1st working day of every month at 10.30 A.M. until further orders".
4. It is represented by the learned counsel for the petitioner that the petitioner could not comply with the bail conditions imposed in the order dated 08.11.2016 and prayed for modification of the conditions.
5. Considering the facts and circumstances of the case, this court is inclined to modify the conditions as infra:-
(i) The petitioner is directed to deposit Rs.5 Lakhs instead of Rs.10 Lakhs into the court as mentioned in the order dated 08.11.2016.
(ii) The petitioner has to execute a Bond for Rs.10 lakhs with two sureties for a likesum, who must be close relatives of the 2nd petitioner/A-3.
(iii) The condition as regards deposit of original Title deed is hereby deleted.
(iv) The petitioner has to report before the EOW-II Police, Coimbatore daily twice at morning 10.00 a.m and evening 5 p.m., and further he shall report before the court on the 1st working day of every month at 10.30 a.m until further orders.
6. This Crl.O.P.No.4372 of 2017, is disposed of accordingly.

It is represented by the learned counsel for the petitioner that time may be given to comply with the condition in respect of deposit of the modified amount ordered by this court by order dated 15.03.2017.
2. Considering the submission made, as far as the condition No.(i) modified by this court, the petitioner is directed to deposit Rs.5 Lakhs instead of Rs.10 Lakhs into the court concerned within a period of three weeks from the date of execution of bail bond.
3. Registry is directed to issue fresh order copy incorporating the above modification.
