JUDGMENT / ORDER

The Principal Sessions Judge, Erode, granted anticipatory bail to the petitioner granting 10 days time to surrender. After the expiry of the 10 days period, the petitioner sought for extension of time before the Court and the same was dismissed, on the ground that the petition was not filed in time. Now the petitioner has come forward with this Criminal Original Petition to quash the said order and to grant further time to the petitioner for surrender, as the petitioner was not able to surrender before the Magistrate due to his ill health.
2. Mr.C.Emalias, learned Additional Public Prosecutor takes notice for the respondent.
3. Considering the facts and circumstances of the case, the order passed by the learned Principal Sessions Judge, Erode, dated 21.12.2016 is quashed and the time for surrender of the accused before the Trial Court is extended for a period of two weeks from today.
4. The Criminal Original Petition is disposed of accordingly.
