THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.11804 OF 2014 ORDER:
This Criminal Petition is filed under Section 482 of Code of Criminal Procedure (Cr.P.C) by the petitioners/A.1 to A.4 seeking to quash the F.I.R. No.763 of 2014 on the file of the P.S., Sanjeeva Reddy Nagar, Hyderabad, registered for the offences under Sections 468, 471, 420 and 506 read with Section 34 IPC.
Heard the learned counsel for the petitioners/A.1 to A.4 and the learned Public Prosecutor and perused the material available on record.
Learned counsel for the petitioners submits that there are civil disputes regarding agreement of sale between the petitioners and the complainant/second respondent, and as such, the second respondent herein has filed a false complaint against the petitioners.
Having regard to the facts and circumstances of the case and also in view of the nature of offences alleged against the petitioners herein, this Court is not inclined to interfere with the proceedings against the petitioners/A.1 to A.4. In view of the fact that the case arises out of the civil disputes and also in view of the submissions made by the learned counsel for the petitioners, the police concerned are directed to complete the investigation without arresting the petitioners/A.1 to A.4 and file final report in accordance with law. The petitioners/A.1 to A.4 are directed to appear before the Investigating Agency as and when their presence is required. The petitioners are also directed to produce all the relevant documents to substantiate their case and cooperate with the Investigating Agency.
With the above direction, the Criminal Petition is disposed of. Consequently, miscellaneous petitions, if any, pending, shall stand closed.
