DESAI) 1 The present application is filed for condonation of delay of 647 days caused in filing the above mentioned Letters Patent Appeal against the orders dated 11.12.2009 passed by the learned Single Judge in Civil Application No. 13078 of 2009 and in Spl. Civil Application No. 3155 of 1992.
We have heard the learned Advocate appearing for the respective parties. No affidavit-in-reply has been filed by the opponents/respondents opposing the present application.
3 Considering the contents of the application, it cannot be said that the delay caused in filing the aforesaid O.J. Appeal has remained totally unexplained. Therefore, we are of the view that the delay caused in filing the aforesaid Appeal deserves to be condoned. Accordingly, this application is allowed. Delay of 647 days caused in filing the aforesaid Letters Patent Appeal is condoned.
