This writ petition was filed complaining that the respondent authorities were attempting to demarcate a portion of the land assigned to the petitioners as house sites. A consequential direction was sought to the respondent authorities not to interfere with their assigned lands.
2. By order dated 17.01.2005, this Court directed status quo obtaining as on that day to be maintained by the parties.
3. Despite lapse of nearly ten years the respondent authorities have not chosen to file counter in this matter.
4. The matter is however amenable to disposal, as the petitioners have produced documentary evidence in support of their claim that the subject lands were assigned to them. As long as the subject assignments are not cancelled, it is not open to the respondent authorities to interfere with the rights of the petitioners pursuant thereto.
5. The writ petition is accordingly disposed of directing the respondent authorities not to interfere with the lands assigned to the petitioners except in accordance with the due procedure laid down by law. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
