(b) to appoint a commissioner to effect division of the properties set out in the schedule hereunder by metes and bounds and to put the plaintiff in possession of his 1/2 share
(c) For costs of the suit.

nvi JUDGMENT Learned counsel for the plaintiff seeks the permission of this Court to withdraw the Civil Suit and he has also made an endorsement to that effect.
2. In view of the endorsement made by the learned counsel for the plaintiff that the matter has been settled out of Court and consequently, the Civil Suit is being withdrawn. No costs.
3. The Civil Suit is dismissed as settled out of Court. Office is directed to refund 50% of the Court fees paid in accordance with rules in the name of Mr.K.Vaidyanathan, learned counsel for the plaintiff.
