Yusufmiyan vs State

(Per : HONOURABLE MR.JUSTICE PARESH UPADHYAY) Rule.

Learned APP, Mr.Pandya, waives service of rule on behalf of respondent-State.

By way of this application, the applicant-convict has prayed that he be enlarged on temporary bail to attend the marriage of his brother's daughter scheduled on 24th April, 2012.

From jail remarks, we find that the applicant was already on furlough leave in January, 2012 itself.

Under these circumstances, the discretion does not deserve to be exercised.

Hence, application is rejected. Rule discharged.
