JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE PARESH UPADHYAY) Rule.
Learned APP, Mr.Pandya, waives service of rule on behalf of respondent-State.
By way of this application, the applicant-convict has prayed that he be enlarged on temporary bail since he wants to take private treatment for his cataract problem.
From application, we find that the certificate issued by the Medical Officer, Vadodara Central Jail dated 30th December, 2011 shows that the applicant needs operation for cataract. The authorities had shown readiness also for the said operation. However, the applicant desires that he be operated through private doctor.
In our view, the ground is not such where the applicant is required to be enlarged on temporary bail to go for private treatment.
Under these circumstances, the application is disposed of. Rule discharged.
However, it is directed that jail authority shall provide appropriate treatment for his illness.
