Heard Sri Anil Kumar, learned counsel for the petitioner and Sri J.K. Upadhyay, learned AGA for State.
According to the petitioner, on his report dated 13.12.2015, offence under Section 302 of IPC was registered as Case Crime No.0300 of 2015, police Station, Bisanda, district, Banda against as many as four accused persons, but till date, only accused Rais Khan has been charge sheeted.
Learned Counsel for the petitioner submits that the police is protecting the respondent no.4, though apparently a case is made out against him also. He submits that a direction be issued to the police authorities to immediately arrest the respondent no.4.
Learned State counsel submits that the police is bound to do fair investigation and the same would be done in accordance with law. He submits that no such order may be passed for arresting the respondent no.4 and let the police investigate the matter.
In view of above, present petition is disposed of finally expecting the police authorities to complete investigation in respect of respondent no.4, expeditiously, in accordance with law. The Superintendent of Police, Banda is directed to look into the matter personally and do the needful.
