JUDGMENT / ORDER

1. In view of the notice issued against the respondent, respondent-Authority has filed affidavit-in-reply (page-22). It is clarified by the respondent at para-9 and para-15as under:
?S9 I say that the laboratory test's for confirming ?Sthe soil bearing capacity?? of the soil in the disputed property were done. The samples of soil were collected sent to the laboratory, where complete analysis was done for which the report has been given by K.C.T. Consultancy Services, which had been received on or around 20th December, 2007.
15 I say that the Nagar Palica is making the best endeavor to make sure that the construction be completed in the earliest possible time. I say that as per the information, which has been received by the Nagar Palika from the Contractor, it is expected that the construction is likely to be completed by September-October, 2008??.
2. Heard learned advocate Mr.Majmudar for the petitioner and learned advocate Mr.Vyas for the respondent. Learned advocate Mr.Vyas has stated that in connection of the para-15, page 27 of the reply of the respondent, structure would be ready by end of October, 2008. Accordingly, respondent is directed to complete the structure by end of October, 2008 and they will follow the procedure as provided in order dated 22.10.2007 passed in Special Civil Application No.13974 of 2007 and cognate matters.
3. In view of said statement made by learned advocates for the parties, nothing survives in this petition. Accordingly, this petition is disposed of. Notice discharged.
