Learned counsel for the applicant has filed supplementary affidavit which is taken on record.
Heard learned counsel for the applicant and the learned A.G.A. have perused the record.
This bail application has been filed on behalf of the applicant involved under Sections 302, 201, 342 of I.P.C., Police Station Cantonment, District Allahabad arising out of case crime No. 168 of 2017.
As per the prosecution case, body of the deceased was found lying in the shrub; ligature mark was seen on the neck of the deceased; name of the applicant surfaced in the statement recorded under Section 161 Cr.P.C. Learned counsel for the applicant submits that the applicant is innocent and languishing in jail since 13.2.2017.
Learned A.G.A. has opposed the prayer for bail submitting that the site plan shows the recovery of the body from near by place of the residence of the applicant which is within the cantonment area; chowkidaar of the cantonment area has stated that the deceased was going inside the cantonment area along with the applicant; it will not be in public interest to enlarge the applicant on bail at this stage.
Considering the facts and circumstances of the case, I am not inclined to allow the bail application.
The bail application is, accordingly, rejected.
The trial Court is directed to expedite the trial and conclude the same expeditiously on day to day basis from the date of production of a certified copy of this order provided there is no other impediment.
Office is directed to send a certified copy of this order to the trial Court concerned for immediate compliance.
