Learned APP Shri K.L. Pandya waives service of rule for respondent State.
The applicant seeks modification of condition of bail order dated 9.5.2007 passed in Criminal Revision Application No.218/2007 and connected proceedings. In the said order, the prayer of the State to cancel the bail granted to the applicants and other co-accused came to be turned down. However, this was on certain condition namely :
"It is, therefore, directed that these the applicants shall not enter Surat District as well as Valia and Ankleshwar Talukas of District Bharuch till the trial is over except for attending the criminal case."
It is this condition that the applicant seeks temporary relaxation on the ground that his deceased brother's son is getting married on 2.5.2012.
Counsel pointed out that previously also on temporary bail this condition was relaxed and no untoward incident was reported.
Under the circumstances, above condition is suspended for a period between 25.4.2012 to 5.5.2012 qua present applicant alone. After the said period is over, conditions shall automatically apply. Application is disposed of. Rule made absolute accordingly.
Direct service is permitted.
