Learned counsel for the applicant has relied upon the decision of this Court in the case of Jagdish N. Solanki vs. State of Gujarat, 2008(5) GLR 4220, and submitted that the course of action adopted by the Investigating Officer and the learned Judicial Magistrate, First Class, is contrary to the law laid down in the above case.
