1. Rejoinder affidavit, filed today, is taken on record.
2. Heard Sri Ram Shiromani Yadav, learned counsel for the applicants and Sri Rajendra Singh, Advocate holding brief for Sri Madan Singh, learned counsel for opposite party no.2 and perused the record.
3. As disclosed in the counter affidavit against the summoning order dated 01.10.2016, the applicants had approached the learned District and Sessions Judge, Moradabad in Criminal Revision No.348 of 2016. Copy of that revision is annexed with the counter affidavit. Also the copy of the order dated 01.05.20167 is annexed with the counter affidavit disclosing that the said case is pending.
4. By means of the rejoinder affidavit, copy of the final order dated 11.5.2018 has been brought on record which discloses that the said Criminal Revision No.348 of 2016 had been dismissed.
5. In view of the said affidavit, present application is not maintainable. It is accordingly, dismissed.
