Heard learned counsel for the petitioner, Sri Gyanesh Kumar Mishra, Advocate holding the brief of Sri K.M. Asthana, learned counsel for the respondent no. 4- Bank and learned Standing counsel for the respondent nos. 1,2 and 3.
The petitioner was disbursed the loan on 06.08.2014 for sum of Rs. 8,98,000/- out of which the petitioner repaid a sum of Rs. 3,00,000/- in between November, 2017 to November, 2018.
A recovery citation has been issued on 14.11.2017 by which the recovery of Rs. 11,76,000/- is to be made from the petitioner.
Learned counsel for the petitioner prays for instalment of payment.
As prayed, the first instalment of Rs. 3,00,000/- will be paid by the petitioner by 15th June, 2019. The second instalment of Rs. 3,00,000/- will be paid by the petitioner by 31st July, 2019. The third instalment of Rs. 3,00,000/- will be paid by the petitioner by 31st August, 2019.
After payment of 3rd instalment the respondent Bank will provide complete statement of account to the petitioner within one week. The petitioner thereafter will pay the entire amount so as indicated in the statement of account by 15th October, 2019.
Any default of the aforesaid conditions, the Bank will be free to proceed against the petitioner.
No recovery charges shall be recovered from the petitioner, if the petitioner complies the above conditions.
With the direction above, the writ petition is finally disposed of.
