Heard Sri Sunil Kumar Tripathi, learned counsel for the applicant and Sri Ashish Pandey, learned AGA for the State.
This application u/s 482 Cr.P.C. has been preferred with the prayer to quash the charge sheet dated 17.5.2017 in Case Crime No. 56 of 2017, under Sections 328, 376, 389, 420, 406 IPC and 66D I.T. Act, P.S. Lal Kurti, District Meerut.
Learned counsel for the applicant submitted that the applicant has got himself bailed out in the present case. Thereafter, he performed marriage. Nikahnama has been annexed as annexure- 5 to this application.
Though, the Nikahnama has been annexed along with the application but the fact that the applicant is living along with the respondent no. 2, any averment has not been made in the application in this regard, on this ground alone, the prayer for quashing the proceedings of the aforesaid case based on the charge-sheet is refused.
The application lacks merit and is accordingly, dismissed.
