JUDGMENT / ORDER

(Per : HONOURABLE THE ACTING CHIEF JUSTICE MR.BHASKAR BHATTACHARYA) Pursuant to our earlier order, the matter has appeared today for further orders.
Ms.
Kalpana Raval, learned counsel appearing on behalf of the Gujarat Pollution Control Board ["GPCB"] submits that during the trial run, there has been no further pollution detected by her client. She, however, submits that the unit of the petitioners should be kept under further observations for at least three months and they should be permitted to continue with their unit on compliance of 19 conditions submitted before us today by her. Those conditions are quoted below:
(1) Compliance by washing Ghats of conditions mentioned in Closure Direction.
(2) Compliance of earlier direction/CTE/CCA by Washing Ghat.
(3) CTE/CCA status of washing Ghat.
(4) Payment of processing fees under Water, Hazardous and Air Act (as applicable).
(5) Details of water consumption and waste water generation.
(6) Details of Effluent Treatment Plant (7) Status of permission for water withdrawal from competent Authority (if applicable).
(8) Permission/membership of JDPA for hazardous waste disposal.
(9) Details of Hazardous Waste storage.
(10) Contract with member printing unit on duly notarized stamp paper.
(11) Names and details of printing units (with code number of JDPA) number of clothes/sarees to be washed. Capacity of washing Ghat associated with the printing units.
(12) Effluent storage provisions during monsoon.
(13) Duly notarized under takiang regarding reuse of water for irrigation and not to discharge untreated/treated trade effluent into nearby water bodies for washing Ghat.
(14) Certificate from JDPA regarding name of Printing units associated with Washing Ghat.
(15) Fresh inspection and Analysis report from 3rd party i.e. VVP Engineering College, Rajkot, or scheduled Environment Auditor with clear opinion/recommendation for trial run extension EMS adequacy/efficiency certificate and feasibility report.
(16) Collection of sample and Inspection by GPCB and analysis report.
(17) Copy of contract with member printing unit for whom work of cloth washing will be carried out.
(18) Names of member printing unit including their Code Number, number of clothes to be washed and capacity of washing Ghat.
(19) Any other condition imposed by this High Court/Expert Committee constituted by the High Court/GPCB.
After hearing the learned counsel for the parties, we find that the proposal given by Ms. Raval is quite reasonable. We accordingly permit the petitioners to continue with their units for further period of three months under the observation of the GPCB on compliance of the aforesaid conditions indicated by Ms. Raval. In case of non-compliance of any of the above conditions, the GPCB will be entitled to mention the matter for further orders.
Let this order be also communicated to the concerned electricity supplying authority.
