Heard learned counsel for the applicants, learned A.G.A. for the State and perused the material on record.
The present application under Section 482 Cr.P.C. has been filed for quashing the impugned order dated 06.04.2021 passed by learned Additional District and Sessions Judge, FTC-IInd, Hapur in Sessions Trial No. 76 of 2019 (State Vs. Washid and others) arising out of Case Crime No. 460 of 2018 under Sections 308, 325, 323, 504 I.P.C. Police Station Pilkhua, District Hapur, whereby application under Section 311 Cr.P.C. for summoning P.W.2 and P.W.7 has been rejected.
Perusal of the impugned order shows that the applicant has not specified the question which is sought to be asked from the witnesses sought to be summoned. It has further been observed that the prosecution witnesses have been examined and the instant application under Section 311 Cr.P.C. has been filed only to linger on the proceedings.
After hearing the learned counsel for the applicants and the learned A.G.A, after perusing the order impugned as well as the averments as contained in the present application, this Court is of the opinion that the learned counsel for the applicants could not point out any good ground which may warrant any interference by this Court in exercise of powers conferred under Section 482 Cr.P.C. for quashing the order impugned.
Accordingly, the prayer for quashing the impugned order is refused.
Present application lacks merit and the same is dismissed.
