This petition has been filed by the petitioner praying for a direction to the Judge small Causes Court, Saharanpur to decide SCC Suit No. 60 of 1998 (Waqf Khuda Bandtala Vs. Fasiuddin) within a stipulated time frame fixed by this Court.
Learned counsel for the petitioner submits that the petitioner is a waqf registered under the Sunni Central Waqf Board Act bearing registration no. 148 in Shahbehlol, District Saharanpur.
The respondent no. 2 - Fasiuddin is a tenant in the said property and a Suit for eviction on the ground of failure to pay rent has been filed by the waqf against the tenant after due service of notice in 1998, till date even the issues have not been framed. The certified and typed copy of the complete order sheet since 7.7.1998 to 22.1.2018 has been filed as Annexure 3 to this petition.
This petition is disposed of with a direction to the Judge Small Causes Court, Saharanpur to decide the aforesaid Suit on merits within a period of three months from the date a certified copy of this order is produced before him.
