JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE D.H.WAGHELA) Not only that the impugned order of learned Single Judge of this Court is admitting the petition of the appellant and granting interim relief, the interim relief is made subject to result of the petition. By making a grievance against such order, what the appellant, an institution of local self-government, is seeking to achieve is complete denial of any relief to its workmen, who were not only stated to be in service of the appellant but who have been fighting for parity in pay since the year 2000 and who are stated to have been inducted into service of the appellant since the year 1989. Therefore, present attempt at challenging even the interim relief in favour of the appellant appears clearly to be an abuse of process of the Court at the cost of public fund. Hence, the appeal is dismissed in limine along with Civil Application.
