1. The present application has been preferred by the applicant under Section 482 of the Code of Criminal Procedure to quash and set aside Criminal Case No. 5361/2005 pending in the Court of learned Chief Judicial Magistrate, Ahmedabad (Rural).
2. After the matter was argued for some time, the applicant seeks permission to withdraw the present application with a liberty to submit an appropriate application for discharge before the concerned Court in case after the investigation is concluded the applicant is chargesheeted.
3. In view of the above, the present application is dismissed as withdrawn with the above liberty. In case after the investigation is concluded the applicant is chargesheeted and any application is submitted by the applicant for discharge before the concerned Magistrate, the same be considered in accordance with law and on its own merits, without, in any way, being influenced by withdrawal of the present application. Rule is discharged. Ad-interim relief granted earlier, if any, stands vacated forthwith.
