1. In Special Civil Application No.3238 of 2011, under order dated 09.03.2011, while directing the office to issue notice, this Court observed that:
"On condition that the parties will maintain status-quo, it is directed that until returnable date, any steps of evicting the petitioner may not be taken."
2. Despite the said observation in the said order dated 09.03.2011 the applicant has taken out present application and prayed for below mentioned relief:
"7(A) THIS HON'BLE COURT be pleased to issue appropriate direction, restraining the Respondent - GIDC or its servants or its agents from taking possession, from the area of plots allotted in favour of applicant, sketch of which produced at Annexure-A, pending hearing and final disposal of SCA No.3238 of 2011;
b) THIS HON'BLE COURT be pleased to restrain the Respondent - GIDC, or its servants or its agents, from allotting the plots in favour of Third Parties from the area of plots in favour, pending hearing and final disposal of SCA No.3238 of 2011;"
3. After making submissions to some extent, learned counsel for the petitioner has submitted that in view of the said observations in the order dated 09.03.2011, and since, by subsequent orders including the order dated 07.12.2011, the ad interim relief has been continued, the applicant does not press this application.
4. Therefore, in view of the statement by learned counsel for the applicant, the application is disposed of as withdrawn at this stage.
