At the instance of Mr. Vibhuti Nanavati learned counsel for the appellant respondent no.4 is ordered to be deleted since the legal heirs are already on record. Mr. Nanavti mainly submitted that the deceased was travelling in a 'goods vehicle' and therefore, the appellant-Insurance Company is not liable. However, Mr. YF Mehta learned counsel for the claimants has relied upon the decisions reported in 2004 (3) SCC 297, 2010 SC 2090 and AIR 1999 SC 1398. However, Mr. Mehta requests for time to rely upon some other judgments. Hence, S.O to 17.02.2012.
