Learned advocate Mr. Jayant P. Bhatt appearing for the petitioner urges that Section 8 of The Public Premises (Eviction of Unauthorised Occupants) Act, 1971 provides that the Estate Officer has the same powers as are vested in a civil Court under the Code of Civil Procedure, when trying a suit particularly in respect of production of documents. Challenge is made to the order passed under Section 9 of the said Act, on 19th March, 2012, where Appellate Court is averred to have erred in holding that this provision of Order 11 Rule 12 of Code of Civil Procedure can be made applicable to the proceedings of the suit only.
Issue notice to the other side returnable on 1st May, 2012.
