New vs Controlling

The note dated 3rd February 2012 is, apparently, taken out under misconception, inasmuch as what is mentioned in the bracketed portion in the order dated 1st February 2012 is actually with reference to the stipulation declaring willingness to deposit the amount in the Registry. However, the petitioner appears to have misconstrued the said bracketed portion as if the payment is to be made to the workman. Hence, any clarification is not required.
