Prima facie the contentions of the learned advocate for the appellant is that the Tribunal erred in holding that the provisions of Section 163A of the M.V. Act would be applicable to the accident in question; that the accident occurred on 29.08.1990 and Section 163A of the M.V. Act was brought into statute book only w.e.f 14.11.1994 and therefore, Section 163A will not be applicable in the present case. However, learned advocate for the respondent requests for time to verify the same. Matter is adjourned to 19.01.2012.
