First Appeal No.1778 of 2012 Learned counsel for the appellant relies on the decision of the Apex Court in the case of National Insurance Company vs. Mastan, reported in (2006) 2 SCC 641, and submits that the claimant, having obtained compensation under the Workmen's Compensation Act, 1923, cannot be allowed to claim compensation under the provisions of the Motor Vehicles Act, for the same cause of action.
