V.Ravi Kumar vs N.Jothi

Madras High Court|05 January, 2017

JUDGMENT / ORDER

This Civil Revision Petition is filed praying to direct the I Additional Family Court, Chennai to complete the trial in O.P.No.2349 of 2013 within a time frame that may fixed by this Court.
2. It is the case of the petitioner that the marriage between himself and the respondent was solomenised on 06.12.2006. It is his grievance that the respondent was not accommodative to him. The respondent left her matrimonial home without any information to the petitioner from March 2007. It was informed to the petitioner that the respondent gave birth to a girl baby and named her "Shrija". The respondent reentered the matrimonial home in February 2008 on negotiation by the relatives of the parties for their re-union. The respondent insisted to live separately, deserting the petitioner's aged mother. In April 2008 again the respondent left her matrimonial home. Hence, the petitioner has preferred O.P.No.2349 of 2012 before the I Additional Family Court, Chennai for dissolution of marriage between them on the ground of cruelty and desertion. The counselling and mediation between them did not yield best results. The petitioner was examined in chief as P.W.1 on 09.01.2005. Thereafter, the respondent absented herself continuously. The documents on the petitioner's side were marked belatedly due to her absence. The case is being posted for cross examination of P.W.1 by the respondent from 28.02.2015, after which, there is no progress in the trial. The respondent was set ex-parte on 23.06.2016 and posted the case for further proceedings to 15.07.2006. The respondent preferred I.A.Nos.2288 and 2289 of 2016 to re-open and re-call the P.W.1's evidence. These I.As were allowed and the case was adjourned for cross examination of the petitioner on 09.11.2016. Till now, there is no progress in the trial. Hence, the petitioner has filed the Civil Revision Petition for the above relief.
3. Heard the learned counsel for the petitioner and perused the materials available on record.
4. Taking into consideration the fact that it is matrimonial dispute between the parties and also taking into account the fact that the respondent is evading the Court proceedings, the learned I Additional Family Court Judge, Chennai is directed to complete the trial and dispose of O.P.No.2349 of 2012 on or before 30.04.2017.
5. With the above direction, the Civil Revision Petition is disposed of. No costs.
