Heard Sri Akhilesh Kumar learned counsel for the applicant and Sri Santosh Kumar Shukla, learned counsel for the respondents.
By order dated 10.07.2018, this Court appointed Mr. Justice Tarun Agarwala, a Former Chief Justice of Meghalaya High Court as Arbitrator subject to the consent of His Lordship in terms of Section 11(8) of Arbitration and Conciliation Act, 1996. The aforesaid proposed Arbitrator has sent his consent in terms of Section 11(8) of the Said Act vide his consent letter dated 21.07.2018.
In view of the aforesaid, Mr. Justice Tarun Agarwala, a Former Chief Justice of Meghalaya High Court residing at Delhi/NCR: A-5, Sector 14, NOIDA, Tele: (0120) 2510066, 2515596 (Mob.
No. 9415307976, 7705007976), Email: tagrawala@gmail.com, is appointed as an Arbitrator to enter upon the reference, and to adjudicate the dispute in accordance with the provisions of Arbitration and Conciliation Act, 1996.
The Arbitrator shall be entitled to fees in accordance with amended 4th scheduled to the Act of 1996. The expenses shall borne equally by the parties. Both the parties are directed to appear before the Arbitrator on 8th August, 2018 at 04.00 pm.
The application is accordingly allowed.
