Heard learned counsel for the applicant, learned AGA for the State and perused the record.
This application under Section 482 CrPC has been filed with a prayer to direct the Chief Judicial Magistrate, Basti to decide the Complaint Case No. 939 of 2019, under Section 138 and 142 of Negotiable Instruments Act, Police Station Purani Basti, District Kanpur Basti within stipulated period.
Learned counsel for the applicant has submitted that complaint case under Sections 138 and 142 of Negotiable Instruments Act, filed by the applicant, is pending since 28.02.2019 and since then, proceeding has been lingering-on, on one pretext or the other.
In view of the above, learned court below is directed to make all endeavours to decide the aforesaid, complaint case as expeditiously as possible, preferably within a period of six months from the date of filing of certified copy of this order without giving any unnecessary adjournments to either parties, if there is no other legal impediment in deciding the aforesaid case.
With the aforesaid direction, this application under Section 482 CrPC is finally disposed of.
