Heard Sri Amit Saxena, assisted by Sri Ankit Gaur, learned counsels for the applicant and Sri Anoop Trivedi, Senior Advocate, assisted by Sri Atul Shahi, learned counsels for the opposite party.
The writ court order came to be passed on 15 February 2019 quashing the appointment of Acting Secretary/Chief Executive Officer of the bank. The writ court order was in the knowledge of the opposite party no. 1, however, the Secretary was permitted to continue until 16 August 2019. This Court vide order dated 31 July 2019, had given an opportunity to the opposite party to comply the order on or before 21 August 2019.
Learned counsel for the applicant does not dispute that the order was complied on 16 August 2019 within the stipulated time granted by this Court.
Having due regard to the facts and circumstances of the case, I do not find any wilful and deliberate disobedience on the part of the opposite party.
The contempt petition is consigned to record. Notice, if any, stands discharged.
