Learned APP, Mr.Pandya, waives service of rule on behalf of respondent-State.
By way of this application, the applicant has prayed that he be enlarged on temporary bail since he wants to attend the mutations / partitions of property.
In our view, the ground is not such where the present of the applicant can be said to be indispensable coupled with the fact that this aspect can be communicated to the competent authority through jail authority.
Considering the totality of the facts, discretion does not deserve to be exercised.
Hence, application is rejected. Rule discharged.
