JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE PARESH UPADHYAY) Rule.
Mr.Pandya, learned APP waives notice of Rule.
The applicant-convict has prayed for temporary bail on the ground that he intends to take treatment for his illness about stone, through private doctor.
On this ground, he was already enlarged on temporary bail for the period from 23.12.2011 to 06.01.2012. Further, the medical certificate dated 31.01.2012 from the Central Jail Dispensary, Ahmedabad makes it clear that the treatment which the applicant-convict desires is available at the Government hospital also and the same is being provided.
Considering these aspects, the discretion does not deserve to be exercised and hence, the application is rejected. Rule discharged.
