Heard learned counsel for the parties.
The petitioner seeks consideration of his candidature for appointment to the post of Village Development Officer by allowing him to participate in the ongoing interview process pursuant to the advertisement no. 3 of 2016.
It is contended that the candidature of the petitioner has been rejected on the ground that he does not possess the requisite "CCC" certificate issued by the DOEACC society.
It is contended by the learned counsel for the petitioner that the petitioner has completed an equivalent course from an Institute known as Advance Information & Multimedia Education Society which is an Autonomous Vocational Training School for Computer Education Training. The certificate in Computer application dated 8.12.2015 has been placed before the Court to submit that the petitioner possess equivalent qualification as that of "CCC" certificate issued by the DOEACC society.
Considering this submission, from a careful perusal of the page '40' of the paper book, it appears that the said institute is established by a registered society in the State of U.P. It is not disclosed as to whether the said institute has been accorded recognition by a competent authority of the State or any University or UGC. The diploma in computer applications, therefore, obtained by the petitioner cannot be said to be from an institute which is a duly established Institute for imparting computer education.
In view thereof, the equivalence claimed by the petitioner with the "CCC" certificate to the diploma at page '40' of the paper book is found devoid of merits.
Insofar as the "CCC" certificate course completed by the petitioner, it would be relevant to note that the same is of a later date i.e. 22.10.2016 whereas the last date of submission of application form for the recruitment in question was 10.2.2016.
For the above noted reasons, it cannot be said that the petitioner possess requisite computer qualification on the cut-off date pursuant to the advertisement no. 3/2016.
No mandamus can be issued. The writ petition is dismissed being devoid of merits.
